Board Meeting Minutes of November 19, 2012

Present:  Chairman Monn, Supervisors Bob Anderson and Tim Mittlestadt Jr., Maintenance Kevin Finder, Clerk-Treasurer Valerie Windsor and townspeople (see sign in sheet)

Chairman Monn called the meeting to order at 7pm at the Stanton Town Shop, Knapp, WI.

Motion to approve minutes as mailed was made by B. Anderson, 2ndby R. Monn.  Approved.

Treasurer’s Report:              Balance on hand, October 1, 2012                       $29,567.41

Motion to approve Treasurer’s Report as mailed was made by R. Monn, 2ndby B. Anderson.  Approved.

Motion to approve Vouchers and Checks was made by R. Monn, 2ndby B. Anderson.  Approved.

Maintenance Report:  Radle Trucking was going against the road ban, Kevin spoke with them.

Kevin will call the town and villages that we share roads with and let them know their portion of the cost of the signs.

Val will contact Century Link about the possibility of terminating our contract for internet at the shop.

Chairman Report:  None

Supervisor Reports:  Bob invited neighbors to a board meeting when we discuss the animal control ordinance.

New Business:  Zoning Referendum – Results of November election concerning zoning:

Remain Unzoned:  129

Township Zoning:  62

County Zoning:  212

Cleo Herrick is here as the administrator of Dunn County Zoning to discuss with us the county zoning.  She stated that because we already have the zoning map for our township done then all we would have to do is adopt the county zoning ordinances.  Because the current county ordinances are under a rewrite our township would have the ability to opt out of being under county zoning within the first year.  This is the first complete rewrite since 1993.  All map amendments (rezones) the township has veto powers. Special Exceptions go to the Board of Adjustment; the township does not have veto power.  Board of Adjustment typically goes along with the township wishes. We can choose to be more restrictive than the county; however that would be up to us to enforce.   Residents can go to the county website to look at the ordinances.  The resident would go to the county to get a land use permit then would have to come to the township and get a building permit.  A special exception would fall under something that could be allowed within your zone, but not automatic.  A rezone would be something that would change the “map”.

Much discussion on the zoning referendum, some suggested we follow how the residents voted, some suggested we remember that we’ve gotten by being un zoned for years, why change now.  Cleo reminded us that we can opt out when the new ordinance is rewritten (they are currently hoping for April 1st, 2013), and then at any time within the first year.

If we decided to go with county zoning we would have to present the map along with the county ordinance to the board of adjustment. They would not be meeting again until the 1stof the year.

Motion was made to adopt the text of the Dunn county zoning ordinance by B. Anderson, 2ndby R. Monn.  2 yes, 1 nay.  Motion carried.

 Comment was made that we allow the residents’ time to come and look at the zone map and possibly make changes if necessary sometime in January.

Extension of the current moratorium – Tim is asking for an extension of 6 months as the Plan Commission needs more time to look into and write ordinances.   Motion was made to extend the current moratorium 6 months was made by B. Anderson, 2ndby T. Mittlestadt Jr.  Approved.  New deadline is now June 19, 2013.

Public Comment:  None 

Val will again contact the web host and ask about putting old minutes into a PDF to make it easier to read on our website.

Question was asked about the DKS pit that was discussed last Monday.

Board Meeting Minutes



Special Meeting on November 12, 2012

Chairman Monn called the meeting to order at 7pm at the Stanton Town Shop, Knapp, WI.


Present:  Chairman Monn, Supervisors Bob Anderson and Tim Mittlestadt Jr., Maintenance Kevin Finder, Clerk-Treasurer Valerie Windsor, townspeople Cindy Griffin, Wayne Rostamo, Jim Michalski, Tim Muran, Jim and Pat Smith, Teresa Golen, Sue Schultz and representative Dale Schmidt (DKS) and Steve (Milestone Materials) and Glen Johnson (Total Excavating).


DKS Pit on 790thAve – Kevin and Bob were looking at roads for the budget process and happened upon Glen Johnson looking into getting 150,000 tons of sand out of the DKS pit within the next months.  They have met with the county and have started the permit process.  They are permitted for 6.9 acres but are planning to stay under that acreage.  The only question is the road.  They would like to take at least  2 board members and take photos of the current road along with all the specs, they are guaranteeing the road will be exactly how it is now before they start.  Dale (DKS) stated he has owned the pit for 20 yrs. They would like to take 40 ft. off the top to get to the silica sand.  DKS has high recommendations from the county on how they take care of the pit.  Hours of operations would be approx. 7am-5pm five days/week, with trucks running approximately 60 loads per day. DNR stated they are still waiting for permits on this.  Plan Commission asked a few questions on the financial aspects of Total Excavating.  The financials are between DKS and Total Excavating as DKS are the employers and they own the pit. DKS would post a bond to cover road costs.  DKS assured us the roads would be taken care of after they are finished.  Suggestion was made that contact be made with everyone on 790thso they know what is going on.  DKS stated they’ve been hauling for years in and out of there and everyone has known.  When the county went in there a few years ago they didn’t contact anyone except the town board.  There will be no blasting.  They will do everything in their power to abide by all safety, noise, dust control, ect.   They will come out of the pit heading west, then south on Q, and onto 12 and up to I-94.  Another suggestion was made to contact neighbors, was stated it could go a long way in building trust.  DKS said they would be willing to do this, if necessary.  Statement was brought up that the pit was there long before any of the houses were on that road.  Bob suggested that because this is a “hot issue” and to help stop rumors it would be a good idea to explain to neighbors and let them know what is going on.  Question was brought up about dust control.  Chris with Total Excavating (previously F&K) is here to explain the financial questions that were brought up.   Total Excavating is on the mend now and is successful in their developments. Total Excavating would have no trouble getting the bond for our township. He would also be willing to provide references if need be.  The moratorium does not apply to this as the pit has been in existence for 35 years, and would be “grandfathered” in.

They would be willing to bond the road cost, talk to the residents on 790th, haul M-F  7am-6pm (maximum).  The board thanked DKS and Total Excavating for coming and explaining in such detail what their plans were.

 Motion was made to draw up the agreement to be signed by both parties, bond would be good for as long as they are hauling out of there, bond will be in the amount of $50,000 by R. Monn, 2ndby B. Anderson.  Approved.


Preliminary budget – the board went over the line items in preparation of the budget hearing.


Motion to adjourn was made by B. Anderson, 2ndby T. Mittlestadt Jr.  Approved.

Attendees:  Chairman Monn, Supervisor Mittlestadt, Supervisor Anderson, Kevin      Finder.


Minutes by Bob Anderson.


Meeting was called to order at 1:02 PM by Chairman Monn.


Bob presented a draft road use agreement.


Discussion on the various aspects of the agreement followed.


Changes needed to be made and the board decided to recess (to allow Bob to go home and make changes) and reconvene 20 minutes later to review the update agreement.


Meeting recessed at 1:42 PM.

Meeting reconvened at 2:12 PM.


Bob presented the revised road use agreement.  (see attached)


Rich made the motion to enter into the agreement as revised if all terms and conditions are met to the Town Board’s satisfaction after the 3 PM meeting with the mine operator at the mine site.  Second by Tim.  Motion carried.


Discussion on having the agreement reviewed by the Town’s attorney followed.


Tim made the motion to have the Town’s Attorney review the agreement.  Second by Bob.  Motion carried.


Bob is to send agreement to Town’s attorney.


Motion to adjourn by Tim.  Second by Bob.  Motion carried.

3 PM Town Board Meeting Minutes

DKS Pit on 790thAve.


Agenda :         DKS Pit on 790thAve. & town road use agreement


Attendees:  Chairman Monn, Supervisor Mittlestadt, Supervisor Anderson, Kevin      Finder, Mark Schmidts DKS, Glenn Johnson Total Excavating, Mike ??? Total Excavating.


Meeting was called to order at 3:02 PM by Chairman Monn.


A discussion on who would contact the neighbors was held.  Total Excavating provided a map showing which neighbors would be contacted and provided a business card that would be left at each of the neighbor’s which has contact information for the company.


A discussion on where DKS/Total Excavating was with acquiring DNR and county permits for the mine was held.


Total Excavating and DKS have been working with Dunn County Land Conservation and the WisDNR, as both have requested additional information.


Total Excavating’s engineer has submitted all of the information to Jim Devlin with the WisDNR.


Total Excavating and DKS have been working with Dunn County Land Conservation  in regards to supplying additional information to the existing reclamation plan.


DKS indicated that the existing Non-Metallic Mining permit with Dunn County is valid and allows them to mine at the site.


The road use agreement was presented to DKS and Total Excavating.


Discussion on this occurred and they were informed that the road ban would not be lifted until the bond has been issued and the DNR and Dunn County have indicated that all permits are in place.


The Town also informed them that the agreement as presented needed to be reviewed by the Town’s attorney and that the Town could not enter into the agreement until after the review has been completed.


A special board meeting may be required for signatures in the near future.


In order to document the existing roadway conditions, all present walked 790thAve. from the mine entrance to county road Q and pictures were taken .  All were in general agreement that roadway showed no signs of defects.

All mine traffic will use 790th  Ave. west of the mine driveway.


Terms of agreement as discussed at the November 12, 2012 Board Meeting:               


  • Mine Operator will contact neighbors


  • Hauling will only occur Monday through Friday and not on holidays and weekends.


  • Hours of operation will be from 7AM to 5 PM


  • Mining and hauling operations are expected to begin in December of 2012 and conclude in June of 2013.


  • Mine Operator will obtain all necessary Federal,            State, County and local permits required for mining operations.


  • Mine Operator will correct any damage on 790th   Ave. caused by the mining and hauling operations to the satisfaction of the Town Board.


  • Mine Operator will obtain a bond in the name of the Town of Stanton in the amount of $50,000 to ensure any damage caused by the mining and hauling operations will be corrected to the satisfaction of the Town Board.    
  • Town Board will lift the weight restrictions on 790th Ave. from the mine driveway to CTH Q when all conditions are met and the bond has been received by the Town Board.


  • Mine Operator agrees to obey and not to haul during seasonal road bans.


  • Town Board agrees to allow the Mine Operator to remove equipment from the mine for 48 hours after the road bans are in place.


  • Town officials and Mine Operator will review the portion of 790th Ave. used as part of the haul route and agree to existing conditions of the roadway prior to mining and hauling operations begin and review roadway conditions again when they are completed.
